By accessing or using this website, you agree to these Terms. If you do not agree, please do not use the website.

About the Website

Heosphor is a design firm working across spaces, materials, systems, and related creative and material practices.

The website may include information about our services, projects, research, processes, objects, ceramics, material experiments, publications, and other work.

The website may also allow visitors to:

• contact Heosphor about potential projects or services;

• submit general inquiries;

• purchase ceramics, objects, or other goods when available; and

• access articles, images, research, or other published material.

Availability of any service, product, project type, or other offering shown on the website is not guaranteed.

Service Inquiries

Information presented on this website is provided to describe Heosphor's work and capabilities. It does not constitute a proposal, quote, professional opinion, guarantee, or commitment to perform services.

Submitting an inquiry, contacting Heosphor, or discussing a potential project does not by itself create a client, consultant, fiduciary, or other professional relationship.

Any engagement to provide professional or creative services will be governed by a separate written proposal, statement of work, contract, or other agreement specifying the applicable scope, fees, responsibilities, deliverables, intellectual-property rights, and other terms.

If a separate agreement conflicts with these Terms regarding a client engagement, the separate agreement will control with respect to that engagement.

Products and Ceramics

From time to time, Heosphor may offer ceramics, objects, prototypes, editions, artworks, or other physical goods for purchase.

Handmade and experimental objects

Many Heosphor objects are handmade, materially experimental, produced in small quantities, or individually finished.

Variations in glaze, surface, texture, dimensions, coloration, firing effects, pattern, form, or other material characteristics may occur. These variations are inherent to handmade and materially produced objects and do not necessarily constitute defects.

Product photography is intended to represent objects as accurately as reasonably possible, but screens, lighting, photography, and the nature of handmade materials may cause appearance to differ somewhat from what is displayed online.

Availability

Objects may be produced as individual pieces, small editions, or limited releases.

Placement of an item in a shopping cart does not guarantee availability. An order is not considered accepted until the transaction has been successfully processed and accepted by Heosphor or the applicable ecommerce provider.

If an item becomes unavailable after an order is placed, the affected amount will be refunded.

We may limit quantities or decline or cancel an order where reasonably necessary, including in cases of inventory error, pricing error, suspected fraud, payment problems, or misuse of the website. If a paid order is canceled by Heosphor, the applicable payment will be refunded.

Prices and taxes

Prices are displayed in the currency indicated on the website and may change without notice before purchase.

Applicable taxes, shipping charges, duties, or other charges will be shown where required or calculated during checkout.

Customers are responsible for any customs duties, import taxes, or similar charges imposed by their jurisdiction unless otherwise stated at checkout.

Payment

Heosphor does not guarantee that every payment method will be available for every transaction.

Shipping and delivery

Where no specific shipping timeframe is stated, orders will be handled in accordance with applicable law.

If circumstances prevent us from shipping an order within an applicable promised timeframe, we will provide any notice, opportunity to consent to delay, cancellation, or refund required by law.

Delivery dates provided by shipping carriers after an order has been dispatched are generally estimates and may be affected by circumstances outside Heosphor's control.

Customers are responsible for providing an accurate and deliverable shipping address.

Returns, exchanges, damage, and refunds

Any return, exchange, cancellation, damage, or refund policy displayed on the product page, at checkout, or elsewhere on the website at the time of purchase forms part of the terms applicable to that purchase.

Nothing in these Terms limits any refund, warranty, cancellation, or other consumer right that cannot lawfully be waived.

Intellectual Property

Unless otherwise indicated, the website and its original contents are owned by or licensed to Heosphor.

This includes, where applicable:

• other original creative material.

You may view and use the website for ordinary personal or business-reference purposes.

You may not, without permission:

• commercially exploit Heosphor content;

• present Heosphor's work as your own;

• remove copyright, attribution, or proprietary notices;

• create unauthorized merchandise or derivative commercial products from Heosphor work;

• use website content to train, develop, benchmark, or supply machine-learning or generative-AI systems except where expressly authorized; or

Nothing in these Terms transfers ownership of Heosphor intellectual property to you.

Names, logos, photographs, trademarks, designs, or other materials belonging to clients, collaborators, manufacturers, photographers, artists, or other third parties remain the property of their respective owners.

Portfolio and Project Material

The website may show completed work, concepts, proposals, studies, prototypes, research, or other project material.

Publication of a project does not necessarily mean that every concept shown was constructed, implemented, commissioned, or adopted.

Project descriptions and images are presented for informational and illustrative purposes and should not be relied upon as construction documents, technical specifications, engineering instructions, or representations about the suitability of a solution for another project or location.

This provision does not apply to claims arising from Heosphor's own wrongful conduct or where applicable law provides otherwise.
